Datenschutzhinweise der Uptrip App

In diesen Datenschutzhinweisen informieren wir Sie über die Verarbeitung Ihrer personenbezogenen Daten im Zusammenhang mit der Nutzung der Uptrip App („App“).

‍

1.  Datenschutzrechtlich Verantwortliche

Die App wird von der Lufthansa Innovation Hub GmbH, Brunnenstrasse 19-21, 10119 Berlin, Germany („Lufthansa Innovation Hub“) als Verantwortliche für die Verarbeitung Ihrer personenbezogenen Daten im Sinne der Datenschutzverordnung der Europäischen Union („DSGVO“) und des Bundesdatenschutzgesetzes („BDSG“) betrieben. Die vollständigen Angaben zum Lufthansa Innovation Hub finden Sie im Impressum. Angaben zur Kontaktaufnahme mit dem Konzern-Datenschutzbeauftragten und der zuständigen Aufsichtsbehörde finden Sie in späteren Ziffern dieser Datenschutzhinweise.

2.  Ihre personenbezogenen Daten

Im Rahmen der Nutzung der App werden folgende personenbezogene Daten verarbeitet:

- Vor- und Nachname

- Email-Adresse

- Miles & More Servicekartennummer  

- Flugdaten von gescannten Tickets (Datum, Flugnummer und Route, Sitz)

3.  Zwecke und Rechtsgrundlagen der Verarbeitung

a)  Nutzungsvertrag

Die von uns erhobenen Daten werden von uns zur Erfüllung der in der App angebotenen Leistungen („Nutzungsvertrag“) verarbeitet (Art. 6 Abs. 1 S.1 lit. b DSGVO – Vertragserfüllung und vorvertragliche Maßnahmen).

So nutzen wir bspw. Ihre Email-Adresse für die Kontaktaufnahme bei der Ausgabe von Prämien oder Informationen zu fehlerhaften Ticketscans. Ihr Vor- und Nachname wird für die persönliche Ansprache sowie den Abgleich der Flugticketdaten genutzt. Gescannte Flugtickets dienen als Grundlage zur Erstellung Ihrer individuellen Sammelkarten.

Ihre Miles & More Servicekartennummer nutzen wir für die Ausspielung von Prämien.

b)  Werbliche Kommunikation

Sie haben die Möglichkeit, uns im Registrierungsprozess oder später in Ihrem Konto eine Einwilligung in die Übermittlung von Informationen und individuellen Angeboten zu den Leistungen der App und in unsere Kontaktaufnahme zu diesem Zweck auf elektronischem Kommunikationsweg (z.B. per E-Mail, Push-Nachrichten) zu erteilen.

Sofern Sie uns eine entsprechende Einwilligung erteilt haben, verarbeiten wir Ihre Kontaktdaten (d.h. Name, E-Mail-Adresse), um Ihnen die Informationen und individuellen Angebote zukommen zu lassen (Art. 6 Abs. 1 S. 1 lit. a DSGVO – Einwilligung)

Sie haben das Recht, Ihre Einwilligung jederzeit zu widerrufen. Weitere Informationen zu Ihrem Widerrufsrecht entnehmen Sie bitte Ziffer 7 dieser Datenschutzhinweise. Durch den Widerruf der Einwilligung wird die Rechtmäßigkeit der aufgrund der Einwilligung bis zum Widerruf erfolgten Verarbeitung nicht berührt.

c)  Sonstige Zwecke

Darüber hinaus verarbeiten wir Ihre Daten zum Zwecke der Betrugsprävention und zur Geltendmachung rechtlicher Ansprüche (Art. 6 Abs. 1 S. 1 lit. f DSGVO - Wahrung berechtigter Interessen - Unternehmerinteresse am Schutz des Unternehmens vor materiellen und immateriellen Schäden).

4.  Empfänger Ihrer Daten

Um Ihnen unsere Services anbieten zu können, setzen wir Dienstleister wie bspw. IT-Dienstleister als Auftragsverarbeiter nach Art. 28 DSGVO ein. Die Dienstleister wurden sorgfältig ausgesucht und arbeiten ausschließlich nach unserer Weisung. Sie weisen zur Einhaltung der datenschutzrechtlichen Pflichten hinreichende Garantien vor.

Je nach Prämie kann es nötig sein, dass wir einen Teil Ihrer persönlichen Daten mit dem die Prämie ausstellenden Partnerunternehmen teilen, damit Ihnen die Prämie ordnungsgemäß ausgestellt werden kann.

Der Miles & More GmbH übermitteln wir die Miles & More Servicekartennummer für die Ausspielung der von Ihnen eingelösten Prämien.

Unter Umständen kann es auch nötig sein, der Fluggesellschaft oder dem Flughafenbetreiber Ihre Daten mitzuteilen, um beispielsweise einen Lounge Zugang zu ermöglichen.

Sofern personenbezogene Daten in Drittländer übermittelt werden, sind zu Ihrem Schutz und dem Schutz Ihrer Daten im Einklang mit den gesetzlichen Voraussetzungen geeignete Garantien vorgesehen (insbesondere Angemessenheitsbeschluss der EU, Anwendung von EU-Standardvertragsklauseln; Informationen zu EU-Standardvertragsklauseln finden Sie auf den Webseiten der Europäischen Union).

Darüber hinaus sind wir in bestimmten Fällen gesetzlich verpflichtet, personenbezogene Daten deutschen und internationalen Behörden zur Verfügung zu stellen (Art. 6 Abs. 1 S. 1 lit. c DSGVO – rechtliche Verpflichtung).

Eine Übermittlung der durch uns erhobenen Daten an sonstige Dritte erfolgt nicht.

5.  Dauer der Speicherung

Wir verarbeiten Ihre Daten, solange es für die Erfüllung unserer vertraglichen und gesetzlichen Pflichten erforderlich ist. Mit Wegfall des Zweckes, zu dem Ihre Daten verarbeitet wurden, werden diese gelöscht, es sei denn, ihre Aufbewahrung ist zu folgenden Zwecken erforderlich:

• Erfüllung handels- und steuerrechtlicher Aufbewahrungsfristen, die sich etwa aus dem Handelsgesetzbuch oder der Abgabenordnung ergeben; diese Fristen betragen bis zu 10 Jahre

• Erhaltung von Beweismitteln im Rahmen der Verjährungsvorschriften. Gemäß §§ 195 ff. des Bürgerlichen Gesetzbuches (BGB) können diese Verjährungsfristen bis zu 30 Jahren betragen, wobei die regelmäßige Verjährungsfrist drei Jahre beträgt.

In diesen Fällen erfolgt eine Sperrung Ihrer Daten, so dass sie zu anderen Zwecken nicht mehr verarbeitet werden können.

6.  Ihre Betroffenenrechte

6.1 Ihre Rechte

Als betroffene Person können Sie bei Vorliegen der jeweiligen gesetzlichen Voraussetzung folgende Rechte ausüben:

• Recht auf Auskunft, Art. 15 DSGVO

• Recht auf Berichtigung, Art. 16 DSGVO

• Recht auf Löschung („Recht auf Vergessenwerden“), Art. 17 DSGVO (siehe auch Ziffer 11 dieser Travel ID Datenschutzhinweise)

• Recht auf Einschränkung der Verarbeitung, Art. 18 DSGVO

• Recht auf Datenübertragbarkeit, Art. 20 DSGVO

• Recht auf Widerspruch, Art. 21 DSGVO (siehe auch Ziffer 7 dieser Travel ID Datenschutzhinweise)

Soweit wir Ihre Daten auf Basis einer Einwilligung verarbeiten, haben Sie das Recht, die Einwilligung jederzeit zu widerrufen, ohne dass die Rechtmäßigkeit der aufgrund der Einwilligung bis zum Widerruf erfolgten Verarbeitung berührt wird.

Um Ihre Rechte auszuüben, können Sie uns über unsere Webseite kontaktieren. Um Ihren Antrag bearbeiten und Sie identifizieren zu können, werden wir Ihre personenbezogenen Daten gemäß Art. 6 Abs. 1 lit. c DSGVO verarbeiten.

Um Ihr Konto zu löschen, können Sie auch wie in Ziffer 8 dieser Datenschutzhinweise beschrieben vorgehen.

Darüber hinaus haben Sie das Recht auf Beschwerde bei einer Aufsichtsbehörde, Art. 77 DSGVO.

7.  Widerspruchsrecht nach Art. 21 DSGVO

Sie haben das Recht, aus Gründen, die sich aus ihrer besonderen Situation ergeben, jederzeit gegen die Verarbeitung der Sie betreffenden personenbezogenen Daten, die aufgrund von Art. 6 Abs. 1 lit. e oder f DSGVO erfolgt, Widerspruch einzulegen.

Wir verarbeiten die Sie betreffenden personenbezogenen Daten nicht mehr, es sei denn, wir können zwingende schutzwürdige Gründe für die Verarbeitung nachweisen, die Ihre Interessen, Rechte und Freiheiten überwiegen, oder die Verarbeitung dient der Geltendmachung, Ausübung oder Verteidigung von Rechtsansprüchen.

Werden die Sie betreffenden personenbezogenen Daten verarbeitet, um Direktwerbung zu betreiben, haben Sie das Recht, jederzeit Widerspruch gegen die Verarbeitung der Sie betreffenden personenbezogenen Daten zum Zwecke derartiger Werbung einzulegen.

Widersprechen Sie der Verarbeitung für Zwecke der Direktwerbung, so werden die Sie betreffenden personenbezogenen Daten nicht mehr für diese Zwecke verarbeitet.

Sie haben die Möglichkeit, im Zusammenhang mit der Nutzung von Diensten der Informationsgesellschaft – ungeachtet der Richtlinie 2002/58/EG – Ihr Widerspruchsrecht mittels automatisierter Verfahren auszuüben, bei denen technische Spezifikationen verwendet werden.

Der Verarbeitung Ihrer personenbezogenen Daten können Sie jederzeit widersprechen.

8.  Löschung Ihres Kontos

Wenn Sie die Services der App nicht länger in Anspruch nehmen möchten, können Sie jederzeit Ihr Konto löschen. Ihre im Rahmen der Nutzung der App erhobenen personenbezogenen Daten werden dann – vorbehaltlich entgegenstehender Aufbewahrungsgründe und -pflichten – unverzüglich gelöscht.

Das Löschen Ihres Kontos können Sie selbst vornehmen, indem Sie sich in Ihr Konto einloggen und den Löschbutton nutzen, der sich bei Ihren Profilinformationen befindet.

Ebenso behalten wir uns vor, Ihr Konto zu löschen, wenn Sie dieses 2 Jahre nicht genutzt haben.

9.  Trackingtools und Cookies

9.1 Trackingtools

Diese Webseite und mobile App benutzen Google Analytics, einen Webanalysedienst der Google Ireland Limited („Google“). Google Analytics verwendet Cookies, die auf Ihrem Endgerät gespeichert werden und die eine Analyse der Nutzung unserer Webseite und mobilen App ermöglichen. Privacy policy for the Uptrip App

In this privacy notice, we inform you about the processing of your personal data in connection with the use of the Uptrip App ("App").

1.     The person responsible under the data protection law

The App is operated by Lufthansa Innovation Hub GmbH, Brunnenstrasse 19-21, 10119 Berlin, Germany ("Lufthansa Innovation Hub") as the controller of your personal data within the meaning of the European Union Data Protection Regulation ("GDPR") and the German Federal Data Protection Act ("BDSG"). Full details of the Lufthansa Innovation Hub can be found in the imprint. Information on how to contact the Group Data Protection Officer and the responsible supervisory authority can be found in later sections of this data protection notice.

2.     Your personal data

The following personal data is processed in the course of using the app:

- First and last name

- Email address

- Miles & More service card number  

- Flight data of scanned tickets (date, flight number and route, seat).

3.     Purposes and legal bases of the processing

a) User contract

The data we collect is processed by us to fulfil the services offered in the App ("usage contract") (Art. 6 para. 1 p.1 lit. b DSGVO - contract performance and pre-contractual measures). 

For example, we use your email address to contact you when issuing rewards or information about faulty ticket scans. Your first and last name will be used for the personal address as well as the matching of flight ticket data. Scanned airline tickets are used as the basis for creating your individual collection cards.

We use your Miles & More service card number for the playout of rewards.

b) Promotional communication 

During the registration process or later in your account, you have the option of granting us consent to send you information and individual offers regarding the App's services and to contact us for this purpose by electronic means of communication (e.g. by e-mail, push messages). 

If you have given us the corresponding consent, we will process your contact data (i.e.name, email address) in order to send you the information and individual offers (Art. 6 para. 1 p. 1 lit. a DSGVO - Consent).

You have the right to revoke your consent at any time. For more information on your right of revocation, please refer to section 7 of this data protection notice. The revocation of consent does not affect the lawfulness of the processing carried out on the basis of the consent until the revocation.

c) Other purposes

In addition, we process your data for the purpose of fraud prevention and assertion of legal claims (Art. 6 para. 1 p. 1 lit. f DSGVO - safeguarding legitimate interests - entrepreneurial interest in protecting the company against material and immaterial damage).

4.     Recipients of your data

In order to be able to offer you our services, we use service providers such as IT service providers as processors in accordance with Art. 28 DSGVO. The service providers have been carefully selected and work exclusively according to our instructions. They provide sufficient guarantees for compliance with data protection obligations. 

Depending on the reward, it may be necessary for us to share some of your personal data with the partner company issuing the reward so that the reward can be properly issued to you.

We transmit the Miles & More service card number to Miles & More GmbH for the purpose of issuing the rewards redeemed by you.

Under certain circumstances, it may also be necessary to provide the airline or airport operator with your data, for example, to enable lounge access.

Where personal data is transferred to third countries, appropriate safeguards are in place to protect you and your data in accordance with legal requirements (in particular, EU adequacy decision, and application of EU standard contractual clauses; information on EU standard contractual clauses can be found on the websites of the European Union).

Furthermore, in certain cases, we are legally obliged to provide personal data to German and international authorities (Art. 6 para. 1 p. 1 lit. c DSGVO - legal obligation).

The data collected by us will not be transmitted to other third parties.

5.    Duration of storage

We process your data as long as it is necessary for the fulfilment of our contractual and legal obligations. When the purpose for which your data was processed ceases to apply, it will be deleted, unless its retention is required for the following purposes:

- Fulfilment of retention periods under commercial and tax law, such as those arising from the German Commercial Code or the German Fiscal Code; these periods are up to 10 years.

 - Preservation of evidence within the framework of the statute of limitations. According to §§ 195 ff. of the German Civil Code (BGB), these limitation periods can be up to 30 years, with the regular limitation period being three years.

 In these cases, your data will be blocked so that it can no longer be processed for other purposes.

6.     Your data subject rights

6.1  Your rights

As a data subject, you may exercise the following rights if the respective legal requirements are met:

 - Right to information, Art. 15 DSGVO

- Right to rectification, Art. 16 DSGVO

- Right to erasure ("right to be forgotten"), Art. 17 DSGVO (see also section 11of this Travel ID Privacy Notice)

- Right to restriction of processing, Art. 18 DSGVO

- Right to data portability, Art. 20 DSGVO

- Right of objection, Art. 21 DSGVO (see also section 7 of this Travel ID Privacy Notice).

Insofar as we process your data on the basis of consent, you have the right to revoke your consent at any time without affecting the lawfulness of the processing carried out on the basis of the consent until revocation.

To exercise your rights, you can contact us through our website. In order to process your request and identify you, we will process your personal data in accordance with Art. 6(1)(c) DSGVO.

To delete your account, you can also proceed as described in section 8 of this privacy notice.

In addition, you have the right to lodge a complaint with a supervisory authority, Art. 77 DSGVO.

7.     Right of objection according to art.21 DSGVO

You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you that is carried out on the basis of Art. 6(1)(e) or (f) DSGVO.

We will no longer process the personal data concerning you unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the purpose of asserting, exercising or defending legal claims. 

If the personal data concerning you is processed for the purpose of direct marketing, you have the right to object at any time to the processing of personal data concerning you for the purpose of such marketing.

If you object to the processing for direct marketing purposes, the personal data concerning you will no longer be processed for these purposes.

You have the possibility, in connection with the use of information society services, notwithstanding Directive 2002/58/EC, to exercise your right to object by means of automated procedures using technical specifications.

You may object to the processing of your personal data at any time.

8.     Deletion of your account

If you no longer wish to use the services of the App, you can delete your account at any time. Your personal data collected in the course of using the App will then be deleted immediately - subject to conflicting retention reasons and obligations.

You can delete your account yourself by logging into your account and using the delete button located in your profile information.

Likewise, we reserve the right to delete your account if you have not used it for 2 years.

9.     Tracking tools and cookies

9.1  Tracking tools

This website and mobile app use Google Analytics, a web analytics service provided by Google Ireland Limited ("Google"). Google Analytics uses cookies that are stored on your terminal device and that enable an analysis of the use of our website and mobile app. The information generated by the cookies about your use of our website and mobile app is usually transferred to a Google server in the USA and stored there.

As part, of the use of Google Analytics, personal data such as IP address, location, time spent on the website and demographic characteristics are collected and processed. This data is used exclusively for the analysis of user behaviour on our website and mobile app and serves to improve the offer for our users.
